Sega and Gearbox Hit with Class Action Lawsuit Over Aliens: Colonial Marines

Any sense of pride Sega and Gearbox may have had for creating one of the worst games of the year has been squashed by a class action lawsuit accusing the developer and publisher of falsely advertising its turd.

The suit was obtained by Polygon who report that it cites “a number of California civil and business codes” that it is claimed the game’s PAX and E3 demos broke.

The demos originally described as gameplay were pored over after the game’s release with numerous sites pointing out the stark differences with the final product.

It is also claimed that by putting the game under embargo until the day of release there was little or no time for the public to fairly judge the quality of the finished product.

A tweet from Randy Pitchford acknowledging the differences between the demo and final game is also included in the suit. It read: “That is understood and fair and we are looking at that. Lots of info to parse, lots of stakeholders to respect.”

Law firm Edelson LLC filed the suit at the North District of California Court on behalf of plaintiff Damion Perrine. Polygon contacted Edelson and got the following reply.

“We think the video game industry is no different than any other that deals with consumers: if companies like Sega and Gearbox promise their customers one thing but deliver something else, then they should be held accountable for that decision.”
